Opinion - XVIII Meeting

The current economic situation around the world is unstable and difficult to predict. According to analysts, an economic downturn as a result of the financial crisis seems to be inevitable. It was made clear in the meeting that IBM Europe has delivered a historic contribution to IBM's worldwide financial performance in Q3. Based on these results, our company has a solid financial basis and is very well positioned to cope with a possible economic slowdown. The EWC is also confident and optimistic about the possibilities of the current market situation.

The recent Q3 Global Pulse Survey results show that IBM employee satisfaction is significantly below the IT industry average. Employee dissatisfaction with the current compensation system contributes to this continued trend in the last four surveys. The current compensation system, running now for two years, does not meet the expectations of the majority of IBM employees. It is the EWC's view that this contributes to employees with business critical skills leaving the company. The constantly moving targets of the Sales Incentive Plan also impact the motivation of the sales force.

The IBM Salary Increase Program is clearly not in line with:

· the profit contribution and 2007 business results communication 'best year ever', apart from compensation paid to senior executives (ref. Yahoo),

· average inflation rates around Europe - 3.6% September 2008, Euro zone (ref. Eurostat) which has an impact on purchasing power and in actual terms is effectively a pay cut over successive years,

· IBM's stated diversity program, ie the fair and equitable application of the Salary Increase Program with particular regard to equal treatment irrespective of gender, age etc.

In a worldwide economy, globally integrated companies like IBM try to make optimum use of the best skills and resources available. The EWC wishes to limit any potential negative impact on the European workforce resulting from the introduction of resources whose Terms & Conditions are less favourable to European colleagues. The EWC requests IBM management to closely monitor the recent worldwide GBS project where 'landed resources' from India and from other parts of the world especially in engagement roles are planned to be part of the European GBS missions. The EWC also requests IBM management to inform and involve the EWC on a regular basis in relation to any developments in this area.

As there are clearly problems in respect of data privacy regarding some of IBM's tools, the EWC requests that IBM management ensures that all such personal data to European employees should be stored and used in accordance with European legislation. Only then can we be assured that such personal data cannot be accessed and used for reasons that are incompatible with its original purpose.

L'attuale situazione economica mondiale appare instabile, con sviluppi di difficile previsione.

Secondo gli analisti è inevitabile una ripercussione negativa sull'economia reale della crisi finanziaria. E' stato, comunque, chiaramente confermato in questo incontro, che l'IBM Europa ha dato un contributo storico alle performances del positivo Q3 dell'IBM WorldWide. Sulla scorta di questi risultati la nostra Azienda ha basi finanziarie solide per affrontare un possibile rallentamento dell'economia.

Anche il CAE (European Work Council) è confidente ed ottimista sulle opportunità del mercato attuale.

I risultati del recente "Q3 Global Pulse Survey" mostrano che la sodisfazione dei dipendenti IBM è al di sotto della media, in modo significativo, nel settore dell'industria IT.

L'insoddisfazione del lavoratore IBM nei confronti dell'attuale sistema salariale contribuisce a continuare un trend negativo da 4 survey successive.

L'attuale sistema salariale, in vigore da 2 anni, non soddisfa le aspettative della maggioranza dei lavoratori IBM. Questo è, secondo il CAE, uno dei motivi per cui "critical skills" lasciano l'azienda. Il costante spostamento dei target del Piano di Vendita & Incentivi incide, anch'esso, negativamente sulle motivazioni delle forze di vendita.

Il Programma di aumenti salariali IBM (IBM Salary Increase Program) è chiaramente non in linea con:

· I profitti conseguiti e l'affermazione che i risultati 2007 sono "i migliori di sempre in assoluto", salvo gli aumenti riconosciuti ai "senior executives" (ref. Yahoo),

· L'inflazione media in Europa – 3.6% a Settembre 2008, Euro zona (ref. Eurostat) - che ha un impatto sul potere d'acquisto ed è, di fatto, un taglio degli stipendi per i prossimi anni,

· La dichiarazione IBM del "diversity program", per es. sulla chiara ed equa applicazione del programma di aumenti salariali rispetto alle condizioni di genere, di età, etc.

In una economia mondiale, imprese globali come IBM cercano di fare ottimo uso degli skills migliori e delle risorse disponibili. Il CAE desidera limitare qualsiasi potenziale impatto negativo sulla forza lavoro europea derivante dall'introduzione di risorse le cui Terms & Conditions siano più favorevoli dei rispettivi colleghi Europei. Il CAE richiede al management IBM di controllare attentamente il recente progetto mondiale della GBS secondo il quale " risorse assegnate dall'India" e da altre parti del mondo, particolarmente in ruoli di "engagement", vengono assegnate in progetti GBS europei.

Il CAE richiede inoltre che il management IBM lo informi e lo coinvolga, secondo le regole europee, in qualunque sviluppo riguardasse questa area.

Poichè ci sono chiari problemi di data privacy per alcuni tools IBM, il CAE richiede che il management IBM assicuri che tutti i dati personali che riguardano i lavoratori Europei siano immagazzinati ed usati secondo le leggi Europee. Soltanto così può essere assicurato che tali dati personali non possano essere raccolti ed usati per ragioni incompatibili con le intenzioni originali.
